1. Agreement to Terms
These Terms of Service govern your use of IBuiltYourSite.com and all websites, hosting, and related services we provide. By requesting a website, subscribing to hosting, or otherwise using our services, you agree to these terms. If you do not agree, do not use our services.
2. Our Services
We design and build a business website at no upfront charge, then host and maintain it for a recurring monthly fee. Your subscription includes hosting, security, ongoing maintenance, and unlimited reasonable content updates requested through your client portal. Optional add-on services are quoted and billed separately.
3. Free Build, Paid Hosting
There is no charge to have your website built and previewed. Your website is only published to a live domain, and only remains live, while an active paid hosting subscription is in place. We may build and display a preview website for your business before you subscribe.
4. Billing, Renewal, and Cancellation
Hosting is billed monthly in advance through our payment processor, Stripe, and renews automatically until cancelled. There is no long-term contract. You may cancel at any time from your client portal; cancellation takes effect at the end of the current billing period. Payments already made are non-refundable, and we do not prorate partial months. If a payment fails and is not cured, we may suspend or remove your website.
5. Ownership of Websites and Materials
IBuiltYourSite.com owns all websites, designs, code, layouts, templates, copy, and other materials we create, whether or not you subscribe. Your subscription grants you a limited, non-transferable license to use your website while your subscription remains active. When your subscription ends, that license terminates and we may take the website offline. Website files, code, and designs are not transferred or exported to you or to a third party.
6. Your Content and Responsibilities
Content you supply — including your business name, logo, photos, menus, pricing, and descriptions — remains yours, and you grant us a perpetual license to use it to build, host, market, and showcase your website. You represent that you have the right to provide that content and that it does not infringe anyone else’s rights. You are responsible for the accuracy of your business information, including hours, pricing, and licensing claims, and for complying with all laws that apply to your business.
7. Acceptable Use
You may not use our services for anything unlawful, deceptive, or abusive, including illegal products or services, adult content, malware, spam, infringing material, or content that harasses or defames others. We may refuse, suspend, or remove any website that violates these terms, at our discretion and without refund.
8. Domains
If we register or connect a domain on your behalf, that domain is used for your website while your subscription is active. Domain registration is subject to registrar rules and fees. You are responsible for any domain you own and control, including renewals.
9. Third-Party Services
Our services rely on third parties, including hosting infrastructure, Stripe for payments, mapping and directory providers, and email and CRM platforms. Their availability and terms are outside our control, and we are not responsible for interruptions or changes caused by them.
10. Availability and Support
We work to keep your website online and fast but do not guarantee uninterrupted or error-free service. Maintenance, updates, and outages may occur. Support requests and change requests are submitted through your client portal and handled during normal business hours.
11. No Marketing Guarantees
We do not guarantee any specific search ranking, traffic volume, lead volume, call volume, or revenue result. Search engines, AI assistants, and directories control their own results.
12. Disclaimer of Warranties
Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law, IBuiltYourSite.com is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data. Our total liability for any claim relating to our services will not exceed the amount you paid us in the three months before the claim arose.
14. Indemnification
You agree to indemnify and hold harmless IBuiltYourSite.com from any claims, damages, losses, and expenses arising from your content, your business, your use of our services, or your violation of these terms.
15. Termination
You may cancel at any time. We may suspend or terminate your access or remove your website if you violate these terms, fail to pay, or use our services in a way that creates legal or operational risk. Sections concerning ownership, content licenses, disclaimers, liability, and indemnification survive termination.
16. Changes to These Terms
We may update these terms from time to time. The current version is always posted on this page, and continued use of our services after an update means you accept the revised terms.
17. Governing Law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, California.
